Building owners are encouraged to join the Validation Scheme by appointing the Prescribed Building Professional (PBP) and/or Prescribed Registered Contractors (PRC) (i.e. the Appointed Persons) to inspect, strengthen (if required) and certify the structural safety of the unauthorised minor amenity features that are relatively small in scale, pose less potential risk and already existed before 1 September 2020. All unauthorised works which commence after 1 September 2020 have to follow the law and will not be covered by the validation scheme.
The legal status of the unauthorised minor amenity features that have been validated remains unchanged and they are still unauthorised building works since no approval has been obtained from the Buildings Department prior to their erection. However, the Buildings Department will not take enforcement action against such validated building works unless they have become dangerous.
